Agreement

By using the MayhemTBD website or hiring MayhemTBD for web design services, you agree to these terms. If you do not agree, please do not use our website or services.

Services we provide

MayhemTBD builds custom websites for small businesses. Our services include web design, development, hosting, maintenance, SEO setup, and related digital services as described on our services page and in individual project agreements.

Quotes and pricing

• All prices listed on our website are base prices for the described scope. Final pricing is confirmed in a written project agreement before work begins.
• Quotes generated through our online configurator are estimates and may be adjusted based on project complexity.
• Payment terms are outlined in each individual project agreement.

Project process

• Work begins after a signed agreement and initial payment.
• You are responsible for providing content, images, logos, and feedback in a timely manner.
• Timeline estimates assume prompt communication. Delays in providing materials or feedback may extend the project timeline.
• We will make reasonable revisions as outlined in your project agreement. Additional revisions beyond the agreed scope may be billed separately.

Intellectual property

• Upon full payment, you own the final website design and content created specifically for your project.
• MayhemTBD retains the right to display the completed work in our portfolio unless otherwise agreed in writing.
• Third-party tools, fonts, and libraries used in your site remain subject to their own licenses.
• You are responsible for ensuring you have rights to any content, images, or logos you provide to us.

Hosting and care plans

• Hosting included in your package covers the period specified in your agreement, typically 12 months from launch.
• After the included hosting period, continued hosting requires an active care plan.
• We are not responsible for downtime caused by third-party hosting providers, DNS issues, or circumstances beyond our control.
• Care plan terms and pricing may be updated with 30 days notice.

Website checkups

Our free website checkup service provides general observations and suggestions. Checkup results are informational and do not constitute a guarantee of specific outcomes if recommendations are implemented.

Scope limitations

MayhemTBD's services constitute website design, development, and conformance review. MayhemTBD does not provide legal advice, tax advice, investment advice, medical advice, or any other professional advice requiring licensure. All findings, recommendations, and implementations are based on publicly available regulatory information and industry best practices as of the date of service. MayhemTBD makes no warranty or representation that any website is legally compliant with any federal, state, or local law, regulation, or rule. Client is solely responsible for ensuring legal compliance and should consult with qualified legal counsel. MayhemTBD's liability for any claim arising from its services is limited to the fees paid for the specific service at issue.

Limitation of liability

MayhemTBD provides websites and digital services on an "as is" basis. We do our best to deliver quality work, but we cannot guarantee specific business results, search engine rankings, or revenue outcomes from any website we build.

Our total liability for any claim related to our services will not exceed the amount you paid for the specific service in question.

Cancellation and refunds

• If you cancel before work begins, any deposit paid will be refunded minus a 10 percent administrative fee.
• If you cancel after work has begun, payment for completed work is non-refundable.
• Care plans can be cancelled with 30 days written notice.

Use of our website

• You may use our website for lawful purposes only.
• You may not attempt to interfere with our website's functionality or security.
• Content submitted through our forms must be accurate and not contain harmful material.

Changes to these terms

We may update these terms from time to time. Changes take effect when posted on this page. Continued use of our website after changes are posted constitutes acceptance of the updated terms.

Governing law

These terms are governed by the laws of the State of New Hampshire. Any disputes will be resolved in the courts of New Hampshire.
