Does my crypto platform need to be registered?
Almost certainly. FinCEN requires MSB registration for any business that transmits or exchanges virtual currency. Most states require money transmitter licenses. And if you trade tokens that are securities, SEC/FINRA registration may be required.
Can I advertise APY on crypto deposits?
Proceed with extreme caution. The SEC has taken enforcement action against BlockFi ($100M), Celsius, and Gemini Earn for offering unregistered securities through crypto lending/yield products. Yield claims on crypto deposits may constitute securities offerings.
